“Rebellion” – A Book Talk with Robert Kagan

The institutions of American law are facing a crisis of confidence. Popular distrust for the courts, the separation of powers, and rule of law itself today threatens to swamp this core pillar of American democracy.

There is perhaps no sharper observer of the broader forces driving these trends than Robert Kagan, senior fellow at the Brookings Institution and columnist for The Washington Post. His new book traces the historical roots of this moment and identifies potential strategies for confronting the threat.

We discussed Kagan’s argument that, “although this crisis seems unprecedented, the struggle that is tearing the nation apart today is as old as the republic.” We also examined the different forms of what he calls “anti-liberalism,” and how they have developed throughout history. And we addressed its impact on America’s legal institutions, as well as what can be done about it.
