“The administration routinely justifies punishing free-thinking institutions on grounds that grants and contracts are privileges, not rights. But the Supreme Court blew away that pretext years ago. In Sherbert v. Verner (1963), the justices explained that “it is too late in the day to doubt that the liberties of . . . expression may be infringed by the denial of or placing of conditions upon a benefit or privilege.” In other words, no one has a right to federal grants and contracts, but everyone has a right not to be denied them for resisting compliance with the chief executive’s personal values..”
